Terms and ConditionsTour OperatorMalaysian Motorcycle Getaways Sdn Bhd a company registered in Malaysia (Company No: 623217-T) providing fully guided tour services in Peninsular Malaysia (West Malaysia) using motorbikes as the primary means of travel.ParticipantsPerson or persons subscribing to the tour services provided by the Tour Operator. What is included in the tourAirport transfer from/to Kuala Lumpur International Airport (KLIA) to hotel/motorcycle depot, a motorcycle for use during the tour, motorcycle security locks, unlimited kilometres, standard motorcycle insurance, accommodation on twin sharing basis, meals during the tour, entry fees for selected sight seeing/events, ferry fees (where applicable), luggage support van, tour guide, tour briefing, and tour orientation pack. What is not included in the tourAirfares to and from Malaysia, air ticket tax, airport taxes, excess baggage charges, tips, any charges levied by state or federal government agencies, accommodation before and after the tour, fuel/gasoline during the tour, snacks, personal accident insurance, damage to the motorcycle up to MYR1,500.00, any expenses due to delay or changes of tour schedule, overbooking of accommodations, default of any third parties, sickness, weather, strike, acts of God, acts of terrorism, force majeure, acts of government’s civil disturbances, war, quarantine, customs regulations, epidemics, criminal activity or for any other cause beyond the Tour Operator’s control, any personal charges such as visa fee, excess baggage charges, phone bills, postage, laundry, drinks, etc, personal expenses, and any items not mentioned as included in the tour. AccommodationAccommodation ranges from staying in hotels, lodges, chalets, or homestay programmes and is based on a twin sharing basis. Single rooms are available at an extra cost over and above the standard tour cost. For Participants travelling by themselves, the Tour Operator will try to pair up the most suitable person. However this option is dependent on the structure of the group, if a suitable person cannot be found for the same tour 21 days prior the start of the tour. The Tour Operator reserves the right to charge the single room supplement cost. MealsBreakfast, lunch and dinner are provided during the tour. Meals shall mostly be based on Malaysian local cuisines at the sole discretion of the Tour Operator. MotorcyclesThe Tour Operator shall provide the motorcycle as the primary means of touring to the Participants during the tour. The type, model and engine capacity of the motorcycles shall be solely determined by the Tour Operator and at all times remain the property of the Tour Operator. The Tour Operator endeavours to provide the motorcycles in good running condition for use during the tour. During the tour the Tour Operator is not obliged to replace a damaged motorcycle, but will do so at their discretion. Licence requirementsMost overseas licences are valid for use in Malaysia; the same restrictions apply as the country of origin. Riders must be 23 years of age or over and have at least one years’ riding experience. Licences must have a motorcycle endorsement. If the Participant’s licence does not have a motorcycle endorsement then an international driving permit will be required. The Tour Operator reserves the right to decline any Participants if the Tour Operator reasonably believes that the Participants do not have valid driving license. Passports and visasThe Participant or Participant's travel agent is responsible for all paperwork requiring entry to Malaysia. All costs of the same shall be borne by the Participants. Tour guides and support vanThe Tour Operator will provide sufficient number of English-speaking tour guides, depending on the number of Participants on the tour. A support van will transport the Participants’ luggage, apart from the daily items the Participants’ carry with them from one destination to the other during the tour. Luggage is limited to one suitcase per Participant. Special arrangementsThe Tour Operator may arrange for other motorcycle accessories (other than those rented out by the Tour Operator), fax and email services, mobile telephones, plus many other things. The Participants are required to inform the Tour Operator in advance to prepare the necessary bookings. There may be a small charge for some of the above. Deposits and final paymentsTo reserve a tour, an initial non refundable booking deposit of 30% of the total tour cost is required. This booking deposit secures your place on the tour package of your choice. The balance is due 30 days before the departure date. If you book your tour within 30 days of the departure date the total tour cost is due on your booking. Cancellations and RefundsParticipants can cancel their tour booking at any time. Cancellations must be received in writing. The following shall apply in cancellation of the tour booking: Cancellations received more than 30 days prior to the tour date are subject to a cancellation fee of the initial 30% per person booking deposit. Cancellations received between 29-15 days prior to the tour date are subject to a fee of 50% of the total rental or tour cost. Cancellations received less than 14 days prior to the tour date are subject to a fee of 70% of the total rental or tour cost. The Participants may however provide a substitute person. The Tour Operator is not obliged to give any refunds once the tour has started regardless of the reason of the Participant being unable to complete the tour. No refunds are payable on any unused accommodation, meals, or any part of the tour, which is unused. In the unlikely event that the Tour Operator has to cancel a tour, the Participants’ monies paid will be refunded in full. The Tour Operator reserves the right to cancel any tour up to 3 weeks before the start of the tour. In this case the Tour Operator will give you the opportunity of placement in any other tours. Default or damageThe Tour Operator shall have the right to terminate the tour of any Participant or Participants and take immediate possession of the motorcycle if the Participant fails to comply with any of the terms and conditions as stated herein, or if the motorcycle is damaged or will probably be damaged due to the wrongful or unreasonable usage by the Participants at any time during the Tour. The termination of the tour under the authority of this clause shall be without prejudice to the other rights of the Tour Operator and the rights of the Participant or Participants under these terms or otherwise. Insurance and Security BondEvery Participant shall be regarded in every respect as carrying
his/her own risk with respect to loss or injury to person or property.
The Tour Operator does not accept responsibility for losses or expenses
due to delay, sickness, weather, strikes, war, and quarantine of other
traveler. The Tour Operator reserves the right to alter routes,
timetable, itineraries, accommodation and other arrangement for the Tour
duly reserved as the Tour Operator deems fit and necessary or in the
case of force majeure. All tours include standard motorcycle insurance covering damage over and above MYR1,500 theft and fire. A damage security bond of MYR1,500.00 is required from the tour Participant (rider only) at the time the motorcycle is picked up before the tour starts. This bond is to be secured with cash or a credit card slip and is fully refundable when the motorcycle is returned undamaged to the Tour Operator at the end of the Tour. Any damage to the motorcycle up to the above mentioned amount will be deducted from the security bond. Optional personal accident insurance is available for the Participants to subscribe which is highly recommended. Prohibited ItemsMalaysia prohibits the unlawful consumption, usage and/or trafficking of drugs, and only prescription medicine is allowed. All firearms are banned from entry and those who wish to bring in any kind, including for sports, must seek a license from the relevant authority. The penalty for those caught in possession of the above prohibited items is death. The Tour Operator shall not be liable in any way whatsoever in the event the Participants being subject to any legal action or proceedings by the relevant authorities due to the breach of this clause. ResponsibilitiesThe Tour Operator acts only as an agent for third party services that are incidental to the travel. All travel arrangements included in this trip are made on Participant’s behalf upon the express condition that neither the Tour Operator nor its agents shall be liable or responsible in the absence of its (or their) negligence for any direct, indirect, consequential, or irregularity of any kind which may be accessioned by reason of any act or omission of any person or entity, including without limitation, any act of negligence or breach of contract of any third party such as an airline, train, motor coach, private car, cruise vessel, boat, or any other conveyance, hotel, sightseeing provider, local ground handler, etc., which is to or does supply any goods or services for the tour. The Participant understands that the Tour Operator neither owns nor operates such third party suppliers and accordingly agrees to seek remedies directly and only with those suppliers and nor hold the Tour Operator responsible for their acts, omissions or commissions. Without their limiting the foregoing, the Tour Operator and its agents are not responsible for any losses or expenses due to delay or changes of schedule, over booking of accommodations, default of any third parties, sickness, weather, strike, acts of God, acts of terrorism, force majeure, acts of government’s civil disturbances, war, quarantine, customs regulations, epidemics, criminal activity or for any other cause beyond its control. All such losses or expenses have to be borne and paid for by the Participants. The Tour Operator accepts no responsibility for value, reliability, quality or authenticity of any goods purchased while on tour or for any mailing, freight or shipping arrangements. The Tour Operator reserves the right to decline to accept, or retain any person as tour Participant, should such person’s health, mental condition, physical infirmity or general deportment impede the operation of the tour or the rights, welfare or enjoyment of other Participants. The Tour Operator does not assume responsibility for bodily injury, nor for any damage or loss to person or property. The Tour Operator reserves the right to substitute hotels, and alter the itinerary, withdraw any tour and make any desirable alteration for the convenience of the operation of the tours. The Tour Operator reserves the right to cancel any tour up to 3 weeks before the start of the tour for any reason. Liability for such cancellation is limited to full refund of money received by the Tour Operator, and this will constitute full settlement with the tour Participants. The Tour Operator is responsible for supplying a motorcycle in good mechanical and running condition, with current registration and standard insurance as required by the Malaysian Road and Transport Department. The Participants shall at all times adhere to the tour rules and regulations which shall be briefed to the Participants during the tour briefing session. The Participants shall exercise caution and care when riding the motorcycle during the tour. Driving/riding while under the influence of alcohol is a serious offence in Malaysia and is subject to heavy penalties from the authorities which may include fine and/or imprisonment. Governing LawsAny contract for these tours is deemed to be made in Malaysia, and shall be governed by the law in Malaysia and any disputes shall be dealt with and heard by an appropriate court in Malaysia. DisclaimerThe Tour Participant(s) or their heirs, legal representatives, successors or assigns, hereby release Malaysian Motorcycle Getaways, its officers, owners, employees, contractors, suppliers and affiliates from any and all legal claims, debts, actions and liability which may arise, directly or indirectly, from participating in any or all aspects of the offered tour, rental or other arrangement, for any loss, injury, death, damages to or in respect to any person or property however caused or arising. The Tour Participant fully understands the risks involved in motorcycling, the booking and cancellation policies, and accepts the terms and conditions that apply to the tour. |
